1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Fan-Wiser ("Service"), operated by Fan-Wiser ("we," "us," or "our"). By accessing or using the Service, you confirm that you are at least 13 years of age and agree to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Fan-Wiser is a personalized NFL streaming guide that helps you find the most cost-effective way to watch your team's games. The Service analyzes your NFL team preferences, location, and existing streaming subscriptions to generate a personalized viewing plan. Features include:

• Personalized NFL streaming plan based on your team and market
• Game schedule with network and time information
• Streaming service and cost comparisons
• Email alerts when your team's game times or networks change
• Optional premium subscription ("Pro") with expanded features

3. Accounts and Registration

To access certain features you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your password and account
• Promptly notify us of any unauthorized account access
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Free and Paid Plans

Fan-Wiser offers a free tier with core features and a paid Pro subscription with expanded capabilities. Paid subscriptions are billed on a recurring basis through our payment processor, Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on the applicable billing cycle.

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Scrape, crawl, or systematically extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its systems
• Transmit any harmful, offensive, or disruptive content
• Use the Service for any commercial purpose without our written consent

6. Third-Party Services and Data

Fan-Wiser integrates with third-party services including:

• ESPN / NFL — for NFL schedule data (game times, networks, and updates). Schedule data is provided by ESPN's public API and is subject to change.
• Supabase — for secure data storage and authentication.
• Stripe — for payment processing. Your payment information is handled directly by Stripe and not stored on our servers.
• Google — if you sign in with Google, you authorize us to access your basic profile information.
• Resend — for transactional and alert email delivery.

We may display affiliate links to streaming services. We may earn a commission when you subscribe through these links, at no additional cost to you.

7. Schedule Information Accuracy

NFL game schedules, networks, and times are subject to change by the NFL and its broadcast partners. While we strive to keep schedule data current through automated updates, we cannot guarantee that all information is accurate at the time you view it. Always verify game times and networks directly with your streaming provider before game day.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Fan-Wiser and are protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Content you submit (such as your team preferences and location) remains yours. You grant us a limited, non-exclusive license to use that content solely to provide and improve the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. NFL SCHEDULE DATA, STREAMING AVAILABILITY, AND SERVICE PRICING ARE SUBJECT TO CHANGE BY THE NFL AND RESPECTIVE PROVIDERS AND MAY NOT ALWAYS BE ACCURATE.

Streaming plan recommendations are for informational purposes only. Actual availability of games may vary based on your location, internet connection, and the streaming provider's current offerings.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAN-WISER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Fan-Wiser and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date above and, where appropriate, by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
